Terms and Conditions

1. General Provisions

1.1 These Affiliate Terms and Conditions (the “Agreement”) establish the rights and responsibilities of individuals or legal entities acting as publishers (the “Affiliate”, “Affiliates”. “you”) within the MyHomeQuote Affiliate Program (the “Program”). By accepting this Agreement and registering as an Affiliate, you confirm that you are bound by this Agreement, as well as MyHomeQuote’s Privacy Policy and any applicable Data Processing Addendum (DPA), all of which may be updated on MyHomeQuote’s website from time to time.

1.2 To register and become eligible under this Agreement, the Affiliate must be a legal adult in their jurisdiction. The person who submits the registration represents they possess full legal capacity and authority to enter into and fulfill the obligations of this Agreement, and will be legally and financially responsible for all actions performed via the account, including those by third parties granted access.

1.3 In these Terms, “MyHomeQuote” refers to the legal entity owning or operating the Affiliate Program (the specific entity may vary based on location or applicable agreement), as designated in any applicable insertion order or onboarding documentation.

1.4. THESE AFFILIATE TERMS AND CONDITIONS MAY BE AMENDED OR CHANGED BY MYHOMEQUOTE IN ITS DISCRETION, WITH OR WITHOUT NOTICE, AT ANY TIME WITH OR WITHOUT ANY REASON.

The Affiliate’s continued access or use of the Program following such changes will be deemed acceptance of such changes. In addition, MyHomeQuote reserves the right to modify or cease providing all or any portion of the services or access to the Program at any time, with or without notice. Be sure to return to this page periodically to ensure familiarity with the most current version of this Agreement.

2. Definitions

2.1 “Client” refers to any entity on behalf of which MyHomeQuote publishes promotional offers.

2.2 “Offer” denotes a marketing or promotional proposal made available by MyHomeQuote via its Program platform, electronic communications, or other channels, and may include additional terms as set by MyHomeQuote and the Client.

2.3 “Program Platform” refers to MyHomeQuote’s website or portal through which the Program operates, including all associated subdomains and pages.

2.4 “Sub-Affiliate” means any third-party publisher engaged by the Affiliate, subject to applicable prior approval and compliance with the terms of this Agreement.

3. Affiliate Program Participation

3.1 Subject to full compliance with this Agreement and applicable MyHomeQuote requirements and policies, Affiliates may access and participate in the Program. Each affiliate is permitted to maintain only one account with MyHomeQuote. Within a single account, affiliates may create and manage an unlimited number of campaigns.

MyHomeQuote may, in its sole discretion, confirm or otherwise verify or check the truth and accuracy of any registration information provided by the Affiliate. MyHomeQuote may request you as account holder to complete an approval procedure (e.g. provide additional information on promotion methods and/or identity, and complete an interview with a MyHomeQuote representative). The Affiliate hereby covenants and guarantees to provide to MyHomeQuote only the truthful and valid information regarding the Affiliate’s identity and location; no fake names, aliases or pseudonyms are to be used to disguise the Affiliate’s identity or hide your contact information. The Affiliate expressly consents to keep contact information up to date and inform MyHomeQuote of any changes.

3.2 Each Affiliate may maintain only one account unless additional accounts are expressly authorized in writing. The Affiliate also acknowledges and agrees that use of the Affiliate’s account is intended for Affiliate only and no other person or entity will be given any access to it and, likewise, the Affiliate will not use any other person’s or entity’s account for its purposes. MyHomeQuote reserves the right to suspend, terminate, or restrict access to accounts that appear linked or created to circumvent system rules or due to deceptive practices; payments associated with such accounts may also be withheld.

3.3 Affiliates may only engage Sub-Affiliates with MyHomeQuote’s explicit prior written consent, and must promptly provide verifiable contact details for each Sub-Affiliate upon request. Sub-Affiliates must agree to comply with specified program provisions, and any breach by a Sub-Affiliate is treated as a breach by the Affiliate.

3.4 The Affiliate and MyHomeQuote are independent contractors. Nothing in this Agreement creates a partnership, joint venture, or employment relationship, nor authorizes the Affiliate to act on MyHomeQuote’s behalf.

3.5 MyHomeQuote may verify the Affiliate’s registration details or operational practices (e.g., website technical setup, content accuracy, third-party rights compliance). Any unauthorized sub-licensing, rental, resale, or outsourcing of Program materials is strictly prohibited.

3.6. In case MyHomeQuote or third-party payment provider requests the Affiliate to prove its identity and location, the Affiliate shall reply within two (2) business days from the day of request and provide valid proof of its identity and location. If at any time MyHomeQuote, in its sole judgment and discretion, determines the Affiliate’s registration information to be misleading, inaccurate or untruthful, MyHomeQuote may restrict, deny or terminate Affiliate’s account, Affiliate’s access and use of, and/or any benefits derived from Affiliate’s participation in the Program; MyHomeQuote may also withhold payment of any commissions and/or other fees that may be or become due or payable to the Affiliate.

3.7. The Affiliate acknowledges and agrees that MyHomeQuote has a right to transfer the Affiliate’s contact/identification information and details of the cooperation to any third party in order to recover debts or to investigate the Affiliate’s fraudulent or illegal activity.

3.8. If account is inactive for a three-month period (i.e. have not started running any campaigns and/or the traffic equal to zero, or the Affiliate did not log into account during 3 months), MyHomeQuote may block account within notice. After the date of notice the Affiliate will have 30 calendar days to restore the account. To do so, the Affiliate has to contact us via affiliate@homequote.io . If the Affiliate does not activate its account, the account will be closed. If the Affiliate’s account is removed based on this section, MyHomeQuote shall not pay out the remaining unpaid commission that is below the minimum payout amount according to section 5.3.

4. Offers and Usage Rights

4.1 Offers are made available exclusively through the Program Platform.

4.2 MyHomeQuote grants each Affiliate a limited, non-exclusive, non-transferable license to access and distribute Offers through approved websites or digital communication channels, subject to this Agreement and any additional terms tied to each Offer.

4.3 Affiliates must not modify or misrepresent Offer content (text, images, branding or other materials) without MyHomeQuote’s prior written approval. The Affiliate is not authorized and shall not change product and service names, trademarks, service marks, design logos, or any promotional materials except with specific permission from MyHomeQuote, for any purpose other than as expressly set forth herein or in any modification to this Agreement by MyHomeQuote. The Affiliate further acknowledges and agrees that any such change will be a material breach of this Agreement and may result in your account being terminated and all money due forfeited.

4.4. MyHomeQuote owns and retains all rights, title and interest in and to its intellectual property, copyright, trademarks, patents, and in the Platform, Program, promotional materials and any other content provided by MyHomeQuote. Upon termination of Affiliate participation in the Program and/ or termination of this Agreement, the grant of right and license set forth herein, shall cease and terminate, and the Affiliate’s right to use the materials shall immediately cease.

4.5. MyHomeQuote does not monitor, supervise or review content contained on Affiliate websites or other media. MyHomeQuote is not responsible for any content appearing or otherwise distributed on, at or in association with Affiliate websites. The Affiliate is solely responsible for the content on Affiliate websites.

MyHomeQuote has no direct or indirect control over the content of Affiliate websites except as specifically set forth in this Agreement and as it relates to the materials, provided by MyHomeQuote.

5. Payments

5.1 Compensation Basis.
Affiliates are entitled to receive compensation strictly in accordance with the agreed rates and terms defined within each Offer. The calculation of payable amounts shall be based solely on the data recorded by MyHomeQuote’s tracking system, which shall be deemed authoritative and final for all billing purposes.

5.2 Payment Schedule.
Unless otherwise specified in writing, payments will be issued on a monthly basis. MyHomeQuote may, at its discretion, allow for different billing cycles (e.g., weekly or bi-weekly) subject to compliance history and payment method availability.

5.3 Minimum Payment Threshold.
Affiliates will only receive payment once accrued commissions meet or exceed one hundred U.S. dollars (USD 100). Any balance below this amount shall be rolled over to the following billing period until the threshold is met.

5.4 Payment Methods.
Payments may be made via bank transfer, ACH, PayPal, Payoneer, or other methods approved by MyHomeQuote. The Affiliate bears all responsibility for providing accurate payment information and assumes any costs or fees associated with receiving payments.

5.5. Taxation.
All individuals, corporations and other organization participants are responsible for the payment of taxes in their own jurisdiction. Each Party bears all payment costs applicable to its servicing bank transfers.

6. Fraudulent or Invalid Activity.

6.1. The Affiliate is not entitled to payment for any activity in violation of the terms of this Agreement.

6.2 If MyHomeQuote determines, at its sole discretion, that an Affiliate or Sub-Affiliate has engaged in fraudulent or invalid activity, or actions likely to damage MyHomeQuote’s reputation or violate applicable restrictions, MyHomeQuote may suspend or terminate the Affiliate’s participation and, if required, share information with regulatory bodies and affected third-parties. MyHomeQuote reserves the right to withhold or deduct payments for actions deemed fraudulent, incentivized without authorization, or generated in violation of these Terms. Affiliates shall not be entitled to any compensation related to such activity.

6.3. MyHomeQuote has the right to deny or withhold payment from the Affiliate and to terminate the Affiliate from the Program immediately if there are an abnormal number of chargebacks or refunds for products and services through the Affiliate’s websites. MyHomeQuote shall determine, in its sole and absolute judgment, what constitutes an abnormal number of chargebacks or refunds.

6.4. If the Affiliate’s account is removed based on the Affiliate request in accordance with GDPR, CCPA or another applicable data protection legislation, MyHomeQuote shall not pay out the remaining unpaid commission that is below the minimum payout amount according to section 5.3.

6.5. MyHomeQuote has the right to deny or withhold payment from the Affiliate and to terminate the Affiliate from the Program immediately if at any time MyHomeQuote considers that the Affiliate’s account has been compromised, or there is a possibility that this Agreement may have been breached or has been breached. MyHomeQuote has the right at its sole discretion to provide a detailed investigation. The Affiliate also agrees to fully participate and cooperate with any investigation at their own cost, including but not limited to providing all required documents.

6.6 In cases where Clients issue chargebacks for invalid leads or traffic, MyHomeQuote may adjust or reclaim previously paid amounts from the Affiliate’s future payouts.

7. Affiliate’s Responsibilities and Duties

7.1 Affiliates must comply with applicable laws and regulations (e.g., anti-spam laws, privacy laws, TCPA) and any additional campaign or Offer-specific policies. All content displayed on any Affiliate website containing the Offer Content must comply with all local laws.

7.2 The Affiliate represents and warrants that Affiliate’s activities, obligations, and responsibilities contemplated under the Agreement, including but not limited to any of use of leads, Affiliate’s websites, databases, campaign materials, Ads, Offer Content, emails and all linked content are, and shall remain at all times during the terms of this Agreement, will not infringe the privacy or other rights of any person and will comply with all applicable federal, state and local laws and regulations including, without limitation, the Telephone Consumer Protection Act, 47 U.S.C. section 227 (“ TCPA ”), its implementing regulations, 47 C.F.R. 64.1200, the Telemarketing Sales Rule, 16 C.F.R. Part 310 (“ TSR ”), and the CAN-SPAM ACT OF 2003, as amended, 15 U.S.C. SECTION 7701 et seq. ( “ CAN-SPAM Act ”) all Do Not Call (“DNC”) rules, and all rules and regulations promulgated by the Federal Trade Commission or Federal Communications Commission thereunder, any and all foreign, federal and state deceptive trade practices legislation, as amended, and all applicable privacy laws.

7.3 Affiliates must refrain from soliciting MyHomeQuote personnel or Clients during and for a defined post-agreement period (e.g., six months). In case of breach, liquidated damages may apply, and injunctive relief may be sought.

7.4 The Affiliate shall ensure that all materials posted by Affiliate or otherwise used in connection with the Program: (i) are not illegal, (ii) do not infringe upon the intellectual property or personal rights of any third party (iii) do not contain or link to any material which is harmful, threatening, defamatory, obscene, harassing, promotes violence, promotes discrimination (whether based on sex, religion, race, ethnicity, nationality, disability or age)

Illegal and prohibited content, including, but not limited to:

  • child pornography or child abuse;
  • content that shows extreme sexual violence or materials that are overly violent;
  • materials that demonstrates, promotes or incites crimes or violent acts;
  • content that promotes terrorism or encourages terrorist acts;
  • materials which encourage violence, criminal behaviour or dangerous behaviour (e.g. creating weapons, taking or making drugs and carrying out fraudulent or terrorist acts);
  • use of materials, promoting a product or a service on behalf of celebrities or politicians without their official permission and consent;
  • use of celebrities or politicians’ names to sensationalize the promoted content (“fake news” and negative representation of the individuals featured);
  • highly graphic sexual acts that would be likely to offend a ‘reasonable adult’;
  • footage that shows real or simulated violence or crimes.

8. Representations and Warranties

8.1 Affiliate Representations.

The Affiliate represents and warrants that:

  • if the Affiliate is an individual person, he/she is over the age of eighteen (18) years or any legal age in the country of the Affiliate;
  • they possess full authority to enter this Agreement;
  • their websites, traffic sources, and marketing practices comply with applicable laws, regulations, and MyHomeQuote’s policies;
  • they will not infringe third-party rights, including intellectual property rights, trademarks, or privacy rights.
  • that the login data or information of its account will always be kept strictly confidential and it will not be shared publicly or with any other person or party. The Affiliate gives its consent that it takes full responsibility for all the activity conducted through its account. In case of any disclosure, theft or unauthorized use of the Affiliate’s login data the Affiliate is obliged to inform MyHomeQuote immediately

9. Confidentiality

9.1 Confidential Information.
For purposes of this Agreement, “Confidential Information” includes, but is not limited to, all non-public business, financial, technical, and strategic information disclosed by MyHomeQuote or its Clients.

9.2 Obligations.
The Affiliate agrees not to disclose, use, or share Confidential Information for any purpose other than the performance of this Agreement. Affiliates must protect such information with at least the same degree of care used to protect their own confidential data, but no less than reasonable care.

9.3 Exceptions.
Confidentiality obligations do not extend to information that (a) is already public without breach, (b) was lawfully received from a third party without restriction, or (c) is required to be disclosed by law or court order, provided that prompt notice is given to MyHomeQuote to seek protective measures.

9.4 Survival.
Confidentiality obligations remain binding for a period of three (3) years following the termination or expiration of this Agreement.

10. Privacy.

10.1 The Affiliate’s personal/corporate data will be collected and processed in accordance with the provisions of law and in accordance with the Privacy Policy and these Terms and Conditions.

10.2 The Affiliate agrees that it will comply with all privacy and data security laws, rules, regulations and self-regulatory principles (“Privacy Laws”), applicable to the Affiliate. The Affiliate shall, at all times during the term, clearly and conspicuously post on its website or other media property an easy-to-understand privacy policy that (i) is in compliance with all applicable laws, rules and regulations, (ii) accurately discloses all applicable data collection, use and disclosure practices, including the use of cookies, pixels, beacons, locally stored objects, or other similar technologies by third parties for purposes of targeting individual end users with advertisements; (iii) identifies how and for what purpose the Affiliate uses the information collected and shares such information with third parties for the purpose of providing more relevant content to users and for advertising and marketing purposes, and (iv) offers users an opportunity to opt-out from such use of the data and information. At all times, the Affiliate and its partners shall comply with their respective privacy policies. At any given point of time, if the Affiliate is unclear or unable to satisfy the terms of this section, the Affiliate shall inform MyHomeQuote in writing. MyHomeQuote is not liable for any violation of Privacy laws, rules or regulations related to failure of the Affiliate to provide appropriate Privacy information to their users.

The Affiliate further agrees that it will not use any information provided to the Affiliate by MyHomeQuote to violate any applicable law, regulation, the Affiliate’s own Privacy Policy or to restore or respawn cookies cleared or deleted by end-users.

11. Non-Disparagement

11.1 The Affiliate agrees and covenants that they shall not at any time make, publish, or communicate to any person or entity or in any public forum, including, without limitation, on any digital or online review sites or forums, any defamatory, discrediting or disparaging remarks, comments or statements concerning MyHomeQuote or its businesses, or any of a MyHomeQuote’s employees or officers, now or in the future. For the purposes of this section, a disparaging or discrediting statement or representation is any communication which, if publicized to another, would cause or tend to cause the recipient of the communication to question the business condition, integrity, competence, good character, or product quality of the person or entity to whom the communication relates, but will not include any disclosure required to be made to any governmental or quasi-governmental agency, or any disclosure made in the course of any pending or threatened litigation, mediation or arbitration.

11.2 In the event the Affiliate failed to perform Non-Disparagement obligations under this section, the Affiliate shall be liable for all losses of MyHomeQuote. MyHomeQuote has the rignt to terminate this Agreement immediately and withhold payments from the Affiliate’s account.

12. Term and Termination

12.1 Term.
This Agreement shall remain in effect from the date of Affiliate’s acceptance and shall continue until terminated by either Party.

12.2 Termination by Either Party.
Either Party may terminate this Agreement at any time, with or without cause, by providing written notice (including by email).

12.3 Termination for Cause.
MyHomeQuote may suspend or terminate the Agreement immediately if the Affiliate breaches any provision, engages in fraud, or violates applicable laws or Offer restrictions.

12.4 Effect of Termination.

Upon termination:

  • All rights granted to the Affiliate under this Agreement shall cease immediately;
  • Any unpaid but valid earnings up to the termination date shall be paid in the next scheduled cycle, unless withheld for fraud or breach;
  • Sections relating to fraud, confidentiality, non-circumvention, non-disparagement, liability, and governing law shall survive termination.

13. Disclaimer of Warranties. Rights of MyHomeQuote

13.1 MyHomeQuote provides the Program, Offers, and related services “as is” without any express or implied warranties, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. MyHomeQuote disclaims all warranties, either express or implied, including, but not limited to, warranties of merchantability and fitness for a particular purpose with regard to the Program and any and all materials of every kind supplied to the Affiliate as part of this Program. MyHomeQuote cannot guarantee the Affiliate any level of success or profitability due to the Affiliate’s participation in the Program. The Affiliate has unilaterally entered into an Internet service business and all risk of loss, cost and expense of the Affiliate doing business shall be borne solely by the Affiliate. In case the Affiliate alters or modifies their promotional links in any way MyHomeQuote shall not guarantee that all traffic sent via such links will be tracked properly and in full.

13.2 MyHomeQuote reserves the right, in its sole and absolute discretion, to terminate the Program at any time and may do so with or without cause.

13.3 MyHomeQuote shall also have the right, in its sole and absolute discretion, to change or modify this Agreement and the Program. If at any time MyHomeQuote changes or modifies the Program, the Affiliate shall have the right to withdraw and terminate participation.

14. Limitation of Liability

14.1 In no event shall MyHomeQuote be liable to the Affiliate for any indirect, incidental, special, or consequential damages (including lost profits, business interruptions, or data loss) arising from this Agreement or participation in the Program.

14.2 The maximum aggregate liability of MyHomeQuote for any claim shall not exceed the total amount of payments actually owed to the Affiliate under this Agreement during the three (3) months preceding the event giving rise to liability.

15. Indemnification

The Affiliate shall indemnify and hold MyHomeQuote, its subsidiaries, affiliates, licensors, content providers, service providers, employees, agents, officers, directors, and contractors and any successor-in-interest or assign (the “Indemnified Parties”) harmless from any breach of this Agreement by the Affiliate. The Affiliate agrees that the Indemnified Parties shall have no liability in connection with any such breach or unauthorized use, and the Affiliate agrees to indemnify for any resulting loss, damage, judgment, award, cost, expense, and attorneys’ fees of the Indemnified Parties. The Affiliate shall also indemnify and hold the Indemnified Parties harmless from and against any and all claims brought by third parties arising out of the Affiliate’s use of the information accessed from MyHomeQuote.

16. Governing Law and Dispute Resolution

16.1 Governing Law.
This Agreement shall be governed by, construed and enforced in accordance with the laws of England and Wales; all matters concerning the performance thereof shall be construed, interpreted, applied and governed in all respects in accordance with the laws England and Wales. Any dispute arising out of or in connection with this Agreement, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration under the LCIA Rules, which Rules are deemed to be incorporated by reference into this clause. The number of arbitrators shall be three. The seat, or legal place, of arbitration shall be London, UK. The language to be used in the arbitral proceedings shall be English.

16.2 Dispute Resolution.
Any disputes arising under this Agreement shall first be attempted to be resolved amicably between the Parties. If not resolved within thirty (30) days, disputes shall be submitted to binding arbitration or the competent courts of the designated jurisdiction, unless otherwise agreed.

16.3 ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS OR REPRESENTATIVE ACTION OR AS A NAMED OR UNNAMED MEMBER IN A CLASS, CONSOLIDATED, REPRESENTATIVE OR PRIVATE ATTORNEY GENERAL ACTION, UNLESS BOTH YOU AND MYHOMEQUOTE ENTITY WITH WHICH YOU HAVE A DISPUTE WITH SPECIFICALLY AGREE TO DO SO IN WRITING FOLLOWING INITIATION OF THE ARBITRATION. THIS PROVISION IS NOT APPLICABLE TO THE EXTENT THIS WAIVER IS PROHIBITED BY LAW.

16.4 YOU HEREBY EXPRESSLY WAIVE ANY RIGHT FOR A TRIAL BY JURY.

17. Final Provisions

17.1 Entire Agreement.
This Agreement constitutes the entire understanding between the Parties with respect to the subject matter and supersedes all prior communications.

17.2 Amendments.
MyHomeQuote may amend this Agreement at its discretion by publishing updated terms on its website. Continued participation in the Program after such updates constitutes acceptance.

17.3 Severability.
If any provision of this Agreement is found unenforceable, the remaining provisions shall remain valid and enforceable.

17.4 Force Majeure.
Neither Party shall be liable for failure or delay in performance caused by events beyond reasonable control, including acts of God, natural disasters, governmental actions, or internet disruptions.

17.5 Assignment.
MyHomeQuote may assign this Agreement without prior notice. Affiliates may only transfer their rights with MyHomeQuote’s written consent.

17.6 Notice.
Notices from MyHomeQuote to Affiliates may be given electronically, including any that we are otherwise required to provide in “writing”. We may send you notices by means of electronic messages to the e-mail address of the Affiliate or to any email address that you provide to us during participation with Program, by general posting on the website, via MyHomeQuote’s Platform or by conventional mail. Communications from the Affiliate to MyHomeQuote may be made via MyHomeQuote’s Platform or e-mail, unless otherwise specified in this Agreement. All notices to MyHomeQuote via e-mail shall be sent to affiliate@homequote.io. Notices from MyHomeQuote shall be deemed delivered when sent by MyHomeQuote to the Affiliate, unless (for email) we are notified that the email address is invalid. Alternatively, we may give you notice by mail to the address provided during registration. You agree to receive offers and promotions from us and our partners by e-mails.

17.7 Acceptance and Execution.
By clicking on the “Sign up” button on the Registration Page, and by supplying MyHomeQuote with all the information required to create an account on the Registration Page, the Affiliate accepts all of the terms and conditions set forth herein above and agrees to be bound by said terms and conditions.
