1. General Provisions
1.1 These MyHomeQuote Contractor Marketplace Terms and Conditions (the “Terms”) govern access to and use of the MyHomeQuote contractor marketplace, customer relationship management interface, lead distribution system, and all related tools, functionalities, and services made available therein (collectively, the “Platform”).
1.2 The Platform is operated by MyHomeQuote (“MyHomeQuote”, “Company”, “we”, “us”, or “our”). These Terms constitute a legally binding agreement between MyHomeQuote and you, as an individual contractor or legal entity (“Contractor”, “you”, or “your”). In these Terms, “MyHomeQuote” refers to the legal entity owning or operating the Platform, including MYHOMEQUOTE CO LTD with its registered office at 38 Antrea Kariolou, Limassol, 4102, Cyprus (the specific entity may vary based on location or applicable agreement and may be designated in the documentation).
1.3 By registering an account, accessing the Platform, selecting a trial or paid subscription, purchasing or receiving leads, or otherwise using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms, together with: (a) the MyHomeQuote Privacy Policy; (b) any subscription plan descriptions, order forms, or pricing information displayed in your account; and (c) any additional policies or guidelines referenced on the Platform (collectively, the “Documents”), all of which are incorporated herein by reference.
1.4 The Platform and Services are intended solely for business and professional use by contractors operating in the United States. No consumer services are offered.
BY ACCESSING OR USING THE PLATFORM IN ANY WAY, YOU ARE AGREEING TO THESE TERMS. IF YOU DO NOT AGREE WITH ANY PROVISIONS OF THESE TERMS, YOU MAY NOT USE THE PLATFORM AND SERVICES. YOU AGREE THAT THESE TERMS ARE ENFORCEABLE LIKE ANY OTHER WRITTEN AGREEMENT SIGNED BY YOU.
BY ACCEPTING THESE TERMS OR BY ACCESSING OR USING THE PLATFORM AND SERVICES IN ANY WAY, YOU ACKNOWLEDGE AND AGREE THAT YOU ARE BOUND BY THESE TERMS, INCLUDING PROVISIONS RELATING TO LIMITATIONS OF LIABILITY, AND, IF YOU ELECT TO PROVIDE YOUR PHONE NUMBER, WE MAY SEND YOU TEXT MESSAGES FOR SERVICES OR PROMOTION RELATED PURPOSES.
2. Definitions
2.1 “Services” means the services provided by MyHomeQuote through the Platform, including subscription access, lead allocation, lead delivery, account administration, CRM functionality, billing, reporting.
2.2 “Lead” means a potential customer inquiry, request, or contact opportunity relating to home or professional services, made available to Contractors through the Platform. Leads are generated and supplied by MyHomeQuote through its own websites and marketing channels and represent individuals who have submitted their information to MyHomeQuote. For clarity, MyHomeQuote does not offer fully exclusive Lead to a single Contractor, the Lead will be available to four (4) Contractors.
2.3 “Subscription” means a trial or paid plan granting the Contractor access to the Platform and Services in accordance with the selected plan features.
2.5 “Credit” means an adjustment applied to the Contractor’s account, when the unused Leads purchased under a Subscription, transferred to the Contractor’s account for allocation in a subsequent billing period. Please note that one (1) Credit corresponds to one (1) Lead. The Credit does not constitute a refund, reimbursement, price reduction, or monetary compensation.
3. Registration, and Account Security
3.1 To use the Platform, you must be at least eighteen (18) years of age and have full legal capacity to enter into these Terms.
3.2 Each Contractor may maintain only one account unless expressly authorized in writing by MyHomeQuote. Accounts may not be shared, sublicensed, resold, or transferred.
3.3 When you register with the Platform, MyHomeQuote will ask you to provide certain contact and personal details. Keep in mind that false, incorrect, or outdated information may prevent you from registering and impair MyHomeQuote’s ability to provide you with the access to the Platform and to contact you. MyHomeQuote will explicitly indicate the fields that are mandatory to complete. If you do not enter the requisite data in these fields, you will not be able to register. You agree we may use such information in accordance with our Privacy Policy. When registering an account with MyHomeQuote, as part of our user identity verification process, you are required to provide your email and password, along with your phone number. MyHomeQuote will send a verification code to your specified email, and you must enter the received code within the Platform. Access to the Platform is granted upon successful verification of the code. To log in, you must use your email address and password.
3.4 You are solely responsible for maintaining the confidentiality of your login credentials and for all activities occurring under your account. MyHomeQuote shall not be liable for any loss or damage arising from unauthorized access to your account.
3.5 MyHomeQuote reserves the right to verify registration information and may suspend or terminate access to the Platform if such information is inaccurate, misleading, fraudulent, or used to circumvent Platform rules.
3.6 The Contractor acknowledges and agrees that MyHomeQuote has a right to transfer the Contractor’s contact/identification information and details of the cooperation to any third party in order to recover debts or to investigate the Contractor’s fraudulent or illegal activity.
3.7 If account is inactive for a 12-month period (i.e. have not started running any activity and/or did not log into account during 12 months), MyHomeQuote may block account within notice. After the date of notice the Contractor will have 30 calendar days to restore the account. To do so, the Contractor has to contact us via support@homequote.io. If the Contractor does not activate its account, the account will be closed.
4. Description of the Services
4.1 Through the Platform, Contractors may: (a) subscribe to trial or paid Subscription plans; (b) receive and manage Leads; (c) purchase Leads on a Subscription or other plan-based basis; (d) use CRM and related tools included in the selected Subscription; and (e) manage billing, reporting, and account settings.
4.2 MyHomeQuote acts solely as a technology and marketplace provider and does not participate in, control, or guarantee the outcome of any transaction between a Contractor and the Lead.
5. Payments
5.1 Access to the Platform and Services is provided through Subscriptions, which may include free trial plans and paid plans. Trial and paid plans differ in features, pricing, lead availability, and usage limits.
5.2 Subscription details, including pricing, billing cycle, included features, renewal terms, and applicable limits, are displayed in the Contractor’s account dashboard. Trials are only available for new Contractors who are signing-up for the Services for the first time.
5.3 Subscriptions may be offered on a monthly basis and unless cancelled may renew for successive billing periods. Auto-payment is disabled by default and is activated only if the Contractor manually enables it within the account settings, selects applicable parameters, and confirms such changes. The Contractor acknowledges and agrees that it may not receive separate renewal notices and, to the extent permitted by applicable law, expressly waive the application of consumer protection laws that require such notices.
5.4 Contractors may cancel a Subscription at any time through their account using the designated cancellation or “unsubscribe” functionality. Cancellation will take effect immediately upon confirmation through the Platform, unless otherwise specified. Upon cancellation, the distribution of new Leads will cease immediately.
5.5 To the maximum extent permitted by applicable law, all amounts payable to Company are non-refundable unless expressly provided otherwise. You agree that you will not be refunded or credited under any circumstances, or for periods in which you did not access the Services. Failure to use Leads or Services does not entitle the Contractor to a refund.
5.6 MYHOMEQUOTE RESERVES THE RIGHT TO INCREASE PRICES FROM TIME TO TIME. IN THE EVENT OF A PRICE INCREASE, MYHOMEQUOTE SHALL PROVIDE YOU WITH NOTICE AT LEAST THIRTY (30) DAYS PRIOR TO THE INCREASE VIA YOUR ACCOUNT OR THE EMAIL ADDRESS ASSOCIATED WITH YOUR ACCOUNT. SUCH CHANGE SHALL NOT REQUIRE ANY ADDITIONAL APPROVAL BY YOU AND WILL GO INTO EFFECT AS LISTED ON THE NOTICE. IF YOU DO NOT ACCEPT THE PRICE INCREASE YOU MUST CANCEL AND CEASE ACCESSING THE PLATFORM OR SERVICES BEFORE THE PRICE INCREASE GOES INTO EFFECT. CONTINUED USE OF THE PLATFORM OR SERVICES AFTER THAT TIME INDICATES YOUR CONSENT TO AUTHORIZE MYHOMEQUOTE TO CHARGE YOUR PAYMENT ACCORDINGLY.
5.7 You must promptly update all of your payment method(s) and related information (for example, a change in your billing address or credit card expiration date) to maintain its accuracy and completeness. We may update the information and continue billing your payment method (e.g. credit card) even after it has expired or been updated, to avoid interruptions and other transactions you authorize.
5.8 If we are unable to collect any amounts owed by you, we may limit your use of the Platform. We may collect those amounts owed using any legal manner without prejudice to any other right or remedy we may be entitled to under these Terms or by law. In the event that the Company brings any action or suit to collect any amounts owed, MyHomeQuote will be entitled to recover its costs, including reasonable attorneys' fees incurred in such collection.
5.9 You are responsible for paying all taxes, excluding only taxes based on Company's net income. If MyHomeQuote has the legal obligation to pay or collect taxes for which you are responsible, the appropriate amount shall be invoiced to and paid by you, unless you provide MyHomeQuote with a valid tax exemption certificate authorized by the appropriate taxing authority.
6. Lead Allocation and Acceptance Rules
6.1 Leads are distributed through the Platform on a first-come, first-served basis, subject to availability, Subscription plan features, geographic coverage, and system capacity.
6.2 Lead may be made available to multiple Contractors simultaneously, up to four (4) Contractors simultaneously.
6.3 No Lead is provided on an exclusive basis.
6.4 MyHomeQuote does not guarantee that any Contractor will receive a minimum number of Leads, the accuracy or completeness of Lead information or that any Lead will result in engagement, conversion, or purchase of services.
7. Credits for Unused Leads
7.1 Subject to the terms of the applicable Subscription plan, any unused Leads purchased within a billing period may be transferred to the subsequent billing period.
7.2 Such transfer is applied automatically within the Contractor’s account. The corresponding number of Lead allocation, where 1 Credit equals one 1 Lead, will be transferred in the next billing period in accordance with the Subscription terms.
7.3 Credits are not refunds, have no cash value, and do not constitute monetary value, reimbursement, or price reduction.
8. Intellectual Property Rights
8.1 The Contractor retains ownership of all content, materials, logos, business information, images, descriptions, and other materials uploaded or made available through the Platform (“Contractor Content”).
By submitting Contractor Content to the Platform, the Contractor grants the Company and its affiliates a non-exclusive, worldwide, royalty-free, transferable license to host, store, reproduce, display, adapt, format, and distribute such Contractor Content solely for the purposes related to the operation, maintenance, improvement, compliance, and promotion of the Platform and Services, and as otherwise permitted by applicable law.
This license remains in effect for as long as the Contractor Content is available on the Platform and, to the extent necessary for archival, promotion, compliance, or backup purposes, thereafter.
The Platform will not publicly disclose private proposals, invoices, internal notes, or project management materials unless expressly made visible by the Contractor.
The Contractor represents that it has all necessary rights to grant this license.
For clarity, MyHomeQuote does not make Contractor proposals, invoices, internal notes, CRM activity history, or communications publicly available except as expressly directed by you through the Platform.
8.2 Platform Content and Materials
All rights, title, and interest in and to the Platform, including its software, architecture, algorithms, interfaces, designs, workflows, lead distribution systems, CRM tools, documentation, and all content and materials created or made available by MyHomeQuote (collectively, “Platform Content”), are and shall remain the exclusive property of MyHomeQuote and its licensors.
Except for the limited rights expressly granted under these Terms, no license or other rights are granted to you, whether express, implied. All rights not expressly granted are reserved by MyHomeQuote.
8.3 Restrictions
The Contractor shall not, directly or indirectly: (a). use Platform Content outside the Platform or except as expressly permitted by these Terms; (b). copy, modify, translate, distribute, sell, sublicense, or create derivative works from the Platform or Platform Content; (c). decompile, reverse engineer, disassemble, or otherwise attempt to derive the source code or underlying structure of the Platform, except to the extent such restriction is prohibited by applicable law; (d). scrape, harvest, index, mine, or collect data from the Platform, including Leads or Contractor Content, for any purpose not expressly authorized under these Terms.
8.4 Use of MyHomeQuote Name and Marks
You may not issue press releases, public announcements, or marketing statements referencing MyHomeQuote or the Platform, or use, display, modify, or combine MyHomeQuote trademarks, logos, or branding, without MyHomeQuote’s prior written consent, except where such use is expressly permitted within the Platform.
9. Representations and Warranties
9.1 Contractor Representations. The Contractor represents and warrants that: (a). have read, understood, and agree to be bound by these Terms and the Privacy Policy; (b). has full power, authority, and capacity to enter into these Terms, and if acting on behalf of a business entity, Contractor is authorized to bind such entity, which shall be jointly and severally liable; (c). Contractor Content and MyHomeQuote’s use thereof as permitted under these Terms do not infringe or violate any intellectual property, privacy, publicity, or other rights of any third party; (d). has all rights and permissions necessary to grant the licenses set forth in these Terms;(e). Contractor Content is not unlawful, misleading, defamatory, obscene, or otherwise harmful; (f). use of the Platform, Services, Leads, and Lead Data complies with all applicable laws, including privacy, consumer protection, and marketing communications laws; (g). is not using the Platform if Contractor is a direct competitor of MyHomeQuote or if account has previously been suspended or terminated; (h). will comply at all times with the intellectual property and usage restrictions set forth in these Terms; and (i). will not misrepresent its identity, credentials, or affiliation in connection with the Platform or any Lead.
9.2 Prohibited Use. The Contractor shall not to: (a). misuse the Platform or attempt to interfere with its operation; (b). access the Platform using automated tools without authorization, disrupt the operation, security, or performance of the Platform or remove, bypass, or disable any security, usage limitation, or access control mechanisms; (c). create multiple accounts to manipulate Lead allocation; (d). post false or deceptive information; (e). solicit or misuse personal data obtained through the Platform; (f). use the Platform for unlawful, fraudulent, or abusive activity; (g). violate these Tems and Documents; (h). copy, resell, redistribute, or commercialize Platform Content, Leads, or data obtained through the Platform; (i). use automated tools, bots, scrapers, or similar technologies to access or extract Platform or Lead data; (j). attempt to gain unauthorized access to accounts, systems, or networks connected to the Platform.
The Platform reserves the right to suspend or terminate access for violations.
10. Communications and Updates
10.1 By submitting any inquiry, message, document, or other information to us through the Platform, including through contact forms, support channels, or other general communication features (collectively, “Communications”), the Contractor acknowledges and agrees that:
a. Communications are submitted voluntarily and at the Contractor’s own initiative;
b. except as expressly provided in these Terms, Communications do not create any contractual, fiduciary, professional, agency, or confidential relationship between the Contractor and MyHomeQuote unless expressly agreed in writing;
c. MyHomeQuote may process such Communications for lawful purposes related to operation of the Platform and provision of the Services, including account administration, customer support, internal analysis, product or service improvement, security, and legal or regulatory compliance; and
d. MyHomeQuote may respond to Communications using the contact details provided by the Contractor but has no obligation to do so.
For clarity, information entered by the Contractor within the Platform’s lead management, CRM, reporting, or account features (including lead notes, activity history, and cooperation records) is processed as part of the Services and handled in accordance with the Privacy Policy and is not subject to the non-confidential provisions set forth above.
The Contractor agrees not to submit through general communication channels any confidential, proprietary, trade secret, sensitive, or legally protected information unless expressly requested by MyHomeQuote and submitted through an approved secure channel.
10.2 MyHomeQuote may communicate with Contractors using the provided contact information for purposes directly related to the Services, including account administration, billing, customer support, service notifications, and Platform or product updates.
By using the Platform and the Services, the Contractor consents to receiving electronic communications from MyHomeQuote related to the Contractor’s account, Subscriptions, Leads, billing, service notices, and Platform or product updates. Such electronic communications form part of the contractual relationship between the parties. The Contractor agrees that any notices, disclosures, agreements, or other communications provided electronically satisfy any legal requirement that such communications be in writing, to the extent permitted by applicable law.
11. Privacy and Regulatory Compliance
11.1 Contractors acknowledge that Leads may involve personal data subject to U.S. federal and state privacy and telecommunications laws, including the Telephone Consumer Protection Act (“TCPA”), or contact information relating to potential customers or other individuals (collectively, “Lead Data”).
11.2 The Contractor may use Lead Data solely for the limited and intended purpose for which it is made available, namely to respond to the applicable Lead or otherwise communicate in connection with the specific service request reflected in the Lead, and strictly in accordance with these Terms and all applicable privacy, data protection, and marketing communications laws and regulations, including without limitation the TCPA and applicable state privacy laws.
The Contractor may disclose or share Lead Data only to the extent strictly necessary to provide the services requested by the applicable Lead and only where such disclosure is permitted by applicable law. The Contractor remains fully responsible for ensuring that any such use or disclosure complies with these Terms and all applicable legal requirements. The Contractor shall not sell, license, rent, transfer, or otherwise commercialize Lead Data, nor use Lead Data for unrelated marketing, lead generation, or prospecting purposes.
The Contractor shall maintain the confidentiality of Lead Data and implement and maintain appropriate administrative, technical, and organizational safeguards designed to protect Lead Data against unauthorized or unlawful access, use, processing, disclosure, alteration, or destruction.
The Contractor shall promptly honor and comply with any lawful request from an individual relating to their Lead Data, including requests to cease communications, opt out, delete, or access personal data, as required under applicable law.
If the Contractor receives any inquiry, complaint, demand, or investigation from an individual, regulator, or other third party relating to the Contractor’s use of Lead Data, the Contractor shall promptly notify MyHomeQuote and reasonably cooperate in good faith to address and resolve such inquiry or complaint.
Where MyHomeQuote makes Lead Data available to the Contractor, MyHomeQuote represents that such Lead Data is made available for the purposes described herein and that the applicable individuals have been informed that their information may be shared with service providers in connection with their request.
Contractors are solely responsible for ensuring that any contact with Leads complies with all applicable laws, including consent requirements, opt-out obligations, do-not-call regulations, and data protection laws.
The Company does not independently verify Lead Data and is not responsible for its accuracy. If the Contractor receives a regulatory inquiry relating to its handling of Lead Data, it shall notify the Platform where such inquiry materially relates to the Marketplace.
11.3 Contractors agree to indemnify and hold MyHomeQuote harmless from any claims, damages, penalties, or liabilities arising out of the Contractor’s use of Lead contact information in violation of applicable law.
12. Independent Contractor Relationship
12.1 The parties are independent contractors. Nothing in these Terms creates a partnership, joint venture, agency, fiduciary, or employment relationship.
13. No Warranty and No Guarantee of Results
13.1 THE PLATFORM, SERVICES, AND LEADS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND.
13.2 MYHOMEQUOTE DOES NOT GUARANTEE THE NUMBER, QUALITY, ACCURACY, OR CONVERSION OF LEADS, NOR THAT ANY LEAD WILL PURCHASE SERVICES FROM A CONTRACTOR, NOR THAT THE LEAD DATA IS NOT ON A DO-NOT CALL LIST.
14. Limitation of Liability
14.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYHOMEQUOTE, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF BUSINESS, LOSS OF DATA, OR BUSINESS INTERRUPTION, WHETHER CLAIMED IN AN ACTION UNDER CONTRACT, TORT (INCLUDING NEGLIGENCE), WARRANTY OR ANY OTHER THEORY, ARISING FROM, OR IN CONNECTION WITH THE USE OF, OR THE INABILITY TO USE THE SERVICES, OR FROM ANY FAILURE, ERROR, OR BREAKDOWN IN THE FUNCTION OF THE SERVICES, OR FROM ANY FAULT, OR ERROR MADE BY MYHOMEQUOTE or MYHOMEQUOTE’S STAFF OR ANYONE ACTING ON MYHOMEQUOTE’S BEHALF, OR FROM YOUR RELIANCE ON THE SERVICES OR CONTENT AVAILABLE ON THE SERVICES, OR FROM ANY COMMUNICATION WITH THE SERVICES, OR FROM ANY DENIAL OR CANCELLATION OF YOUR ACCOUNT, OR FROM RETENTION, DELETION, DISCLOSURE OR ANY OTHER USE OR LOSS OF YOUR CONTENT ON THE SERVICES OR THE PALTFORM, ARISING OUT OF OR RELATING TO THE PLATFORM, THE SERVICES, THE LEADS, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES..
14.2 MYHOMEQUOTE’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS, THE PLATFORM, THE SERVICES, OR THE LEADS SHALL NOT EXCEED THE TOTAL FEES PAID BY THE CONTRACTOR TO MYHOMEQUOTE DURING THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
15. Indemnification
15.1 Indemnification by Contractor. The Contractor shall defend, indemnify, and hold harmless MyHomeQuote, its parent companies, subsidiaries, affiliates, licensors, service providers, and each of their respective officers, directors, employees, agents, successors, and assigns (collectively, the “Indemnified Parties”) from and against any and all claims, demands, actions, proceedings, investigations, damages, losses, liabilities, penalties, fines, judgments, settlements, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:
- (a) the Contractor’s access to or use of the Platform, Services, or Leads;
- (b) any contact, communication, or interaction by the Contractor with a Lead, including by phone, SMS, email, or other means;
- (c) any alleged or actual violation of applicable laws or regulations by the Contractor, including without limitation the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, state privacy laws, consumer protection laws, or data protection regulations;
- (d) the Contractor’s failure to obtain, rely upon, or honor any required consumer consent, opt-out request, or do-not-call obligation;
- (e) any dispute, transaction, or interaction between the Contractor and a Lead or customer;
- (f) any content, representations, offers, services, or communications provided by the Contractor; or
- (g) the Contractor’s breach of these Terms or any Documents.
15.2 Indemnification Procedure. MyHomeQuote shall promptly notify the Contractor of any claim subject to indemnification; provided, however, that failure to provide prompt notice shall not relieve the Contractor of its indemnification obligations except to the extent materially prejudiced. The Contractor shall assume control of the defense and settlement of the claim, provided that the Contractor may not settle any claim in a manner that imposes any admission of liability or obligation on any Indemnified Party without MyHomeQuote’s prior written consent. MyHomeQuote may participate in the defense with counsel of its own choosing at its own expense.
15.3 Survival. The obligations set forth in this Section shall survive termination or expiration of these Terms.
16. Modifications to the Platform and Terms
16.1 MyHomeQuote may modify, suspend, or discontinue the Platform, Services, Subscription plans, or pricing at any time.
16.2 MyHomeQuote may amend these Terms by posting an updated version on the Platform. Continued use of the Platform constitutes acceptance of the revised Terms
17. Term and Termination
17.1 Term. These Terms are effective upon the Contractor’s registration or first use of the Platform and remain in effect on an ongoing basis unless and until terminated in accordance with this Section. These Terms are not for a fixed term or minimum duration.
The Contractor may terminate these Terms at any time by cancelling their account or Subscription through the Platform.
MyHomeQuote may suspend or terminate these Terms, the Contractor’s account, any Subscription, or access to the Platform or Services, in whole or in part, at any time, in its sole discretion, with or without cause and with or without prior notice, subject to applicable law.
In the event that MyHomeQuote: (i) becomes the subject of a voluntary or involuntary bankruptcy, insolvency, receivership, liquidation, or similar proceeding that is not dismissed within sixty (60) days; (ii) admits in writing its inability to pay its debts as they become due; (iii) makes an assignment for the benefit of creditors; or (iv) ceases to operate as a going concern, MyHomeQuote may terminate the Platform and these Terms. Where reasonably practicable, MyHomeQuote may provide prior notice of such termination.
The Contractor acknowledges and agrees that MyHomeQuote assumes no responsibility or liability for termination of the Platform or Services, including any resulting loss of data, account history, Leads, or Credits.
17.2 Contractor-Initiated Termination.
The Contractor may terminate participation in the Platform at any time by cancelling their Subscription or closing their account through the account settings or by providing notice to MyHomeQuote at the support email address specified on the Platform.
Upon termination, any unused Leads, Credits, trial benefits, or prepaid amounts remaining in the Contractor’s account shall be forfeited, unless otherwise expressly required by applicable law.
17.3 Effect of Termination.
Upon termination of these Terms for any reason:
the Contractor’s right to access or use the Platform and Services shall immediately cease;
the Contractor shall remain responsible for all fees, charges, or amounts accrued up to the effective date of termination;
the Contractor shall not be entitled to any refunds, reimbursements, or compensation for unused Subscription time, unused Leads, or Credits, except as required by applicable law.
Sections that by their nature should survive termination, including but not limited to payment obligations, limitations of liability, indemnification, compliance obligations, and governing law, shall survive termination.
17.4 Termination for Breach.
If these Terms are terminated due to the Contractor’s breach of any provision, including any false, misleading, or inaccurate representation, warranty, or compliance obligation, MyHomeQuote reserves the right, to the fullest extent permitted by law, to suspend or withhold any unused Leads, Credits, or other account benefits and to pursue any remedies available under these Terms or applicable law.
18. Governing Law and Jurisdiction
These Terms and any dispute, claim, or controversy arising out of or in connection with these Terms, the Platform, or the Services (including any non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter or formation. Each party waives any objection to the exercise of such jurisdiction, including any objection based on venue or forum non conveniens.
Nothing in this Section shall limit the application of any mandatory laws that may apply by operation of law. These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
